Regulation (EU) 2024/1183, known as eIDAS 2.0, establishes the European Digital Identity Wallet framework. Wallets support identification, sharing digital credentials and electronic signatures. Member states must provide wallets, and specified services must accept them under the regulation’s conditions. These obligations do not require individuals to use a wallet. Article 5a(15) expressly makes use voluntary and protects non-users against restrictions or disadvantages in access to public and private services, employment and business activity. Other existing identification and authentication methods must remain available.
What’s at stake
The framework puts digital identity into more everyday transactions. Our concern is whether rollout preserves meaningful alternatives and prevents excessive data demands or pressure to identify. Those are implementation risks to scrutinise, not proof that the regulation mandates wallet use or automatically links everyone’s records.
Our take
We oppose the expansion of identity-gated access and will scrutinise how the wallet is deployed. The voluntary-use and non-discrimination protections are real legal safeguards, not merely assurances. Our concern is whether they are enforced in practice, particularly where wallets are used for online age checks. Mandatory provision or acceptance must not be confused with mandatory use.
