HF 864 creates Iowa Code chapter 554J. A site, app or segment of one, including on a social media platform, must use "reasonable age verification" if 33% or more of its public content is pornographic for minors. Allowed methods are a digital ID, a commercially reasonable method using transactional data, or a method the Attorney General approves by rule, and verifiers may not keep identifying information. The Attorney General enforces the law with fines up to $1,000 per violation, capped at $10,000 a day, with each access counted as a separate violation and no private right of action.
What’s at stake
The segment clause reaches parts of larger platforms, so a social media service can be covered because of what some accounts post. Adults must prove their age to a verifier before viewing lawful material, and the digital ID option ties that access to a government credential.
Our take
Iowa took 13 months to move this bill from House passage to the governor, and the final text still leaves the approved verification methods to the Attorney General's rulebook. Adults in Iowa now need an ID trail to see material the Constitution protects for them.
