SB 372 required app stores to request the age category of anyone in Kansas opening an account and verify it, using commercially available methods or a method set by attorney general rules, and existing accounts had to be verified as well. Minors' accounts had to be linked to a parent account, with verifiable parental consent for each download or purchase, and app stores had to pass age data to developers. The attorney general would enforce it under the Kansas Consumer Protection Act, at $7,500 or more per violation, after the Senate Judiciary Committee removed a private right of action. Most provisions would have taken effect January 1, 2027.
What’s at stake
The check applied to account holders of all ages, so adults would have had to verify their age just to use an app store. Developers would then receive age data about their users from the store.
Our take
When SB 372 stalled in the House, conferees moved its text into HB 2422, a bill about grain and hay theft, and the Senate approved that report 34-6. The House did not adopt it, and the bill died on the calendar in May. Moving an age verification mandate into a farm theft bill gave its backers a path to passage without a standalone House floor vote.
