SB 757 bars platforms from serving an "addictive feed" to a user unless the platform has used "commercially reasonable and technically feasible methods" to determine the user is not a minor under 18, or has verifiable parental consent. The attorney general would write rules on the age-determination methods, and data gathered for the check may be used only for that purpose and must be deleted immediately. It also bars feed notifications to minors from 10 p.m. to 6 a.m., and from 8 a.m. to 4 p.m. on weekdays from September 1 to May 31. The attorney general enforces it, with fines up to $5,000 per violation.
What’s at stake
A personalized feed is the default way most people use social media, so the bill puts an age check in front of ordinary use for adults. It copies New York's SAFE for Kids Act, which pushes platforms to check the age of anyone who wants an algorithmic feed.
Our take
The Senate passed SB 757 by three votes as part of the "Kids Over Clicks" package, and the House has until December 31 to act. The immediate-deletion rule governs what happens after the check, and adults still have to submit to the check to keep their feeds.
